Employment Litigation

We represent employees from all walks of life and across all industries in every aspect of their working lives. However, when litigation becomes necessary, we pursue employment actions vigorously in Florida state court and in federal courts across the nation, bringing an unshakeable commitment to serving our clients passionately for as long as the representation may require.

ERISA and Employee Benefit Plans

We represent the interests of employees, retirees, and plan participants or beneficiaries in their pursuit of economic justice related to the mismanagement of employee retirement benefit plans governed by the Employee Retirement Income Security Act (ERISA), including:
  • \

    401(k) or 403(b) plans

  • \

    Employee Stock Ownership Plans (ESOPs)

  • \

    Traditional pension plans

  • \

    Health and welfare plans

Unpaid Bonuses, Commissions, and Other Earned Benefits

Your compensation is more than a base salary. Many employees are promised bonuses, commissions, and other benefits as a condition of taking a job or as part of an employment agreement, only to have those amounts withheld, reduced, or denied when payment comes due. We represent employees who have not received the compensation they were contractually promised — including annual and performance bonuses, sales commissions, deferred and incentive compensation, and other contractually required benefits. We work to recover what you have earned, whether by negotiating with your employer or, when necessary, by pursuing your claim in court.

Workplace Discrimination and Wrongful Discharge

The law protects your right to work free from discrimination and to keep your job unless there is a lawful reason to end it. When an employer makes decisions based on race, color, national origin, sex, pregnancy, age, disability, religion, or another protected characteristic — or fires you in retaliation for asserting your rights, reporting unlawful conduct, or taking protected leave — that conduct can violate federal and Florida law. We represent employees who have been demoted, passed over, harassed, or terminated for unlawful reasons, holding employers accountable through negotiation where possible and litigation where necessary, and pursuing the full measure of what the law allows — including lost pay, reinstatement or front pay, emotional distress damages, and attorneys’ fees.
